Orange Sky New Zealand (“Orange Sky“, “we“, “us” or “our“) cares about protecting your privacy and is required by law to comply with the Privacy Act 2020 (the Act). The Office of the Privacy Commissioner provides further details of the Act and how it protects personal information in New Zealand.

We take our privacy obligations seriously and this Policy outlines our privacy practices. It explains how:

(b) you may access and request the correction of your personal information; and

This Policy applies to our staff, volunteers, contractors and suppliers who handle personal information collected by us and our related entities from time to time.

When you access or use our website https://orangesky.org.nz or any associated pages (including our social media pages) (“Website“), or when you provide personal information to us, you consent to the collection, use, storage and disclosure of your personal information in accordance with the Act and this Policy.

This Policy applies in addition to, and does not limit, the rights and obligations under the Act.

In order to provide our services to you, we may need to collect some personal information about you. We will only collect personal information in accordance with this Policy and the Act.
Personal information means information about an identified individual, or an individual who is reasonably identifiable.

The personal information we collect may include:
(a) your name, address, contact details, bank and credit card details for clients, volunteers, suppliers and donors;
(b) your image, video and sound recordings;
(c) information associated with web browsing, email, text messaging, phone calls or other electronic interaction with you including your phone number and user name;
(d) for donors, details relating to your donations and information relevant to the purpose of better identifying donor sources;
(e) for others, other information relevant to the purpose of providing services such as education qualifications, employment history, interests, feedback preferences, user names and passwords, service feedback and complaint details;
(f) sensitive information about you that may include your gender, age, date of birth, health, disability, mental health, racial or ethnic origin, criminal convictions, religious affiliation, tax file numbers, and other particulars; and
(g) survey and questionnaire responses.

The personal information we collect from you will depend on how you interact with us, including how you use our Website and services.

If you provide us with another person’s personal information, you should ensure you are authorised to do so.

You do not have to provide us with the information we request, however, if you do not do so, this may affect the services we can provide to you, or your use of our website.

We will:

(c) Establish reporting channels to receive privacy inquiries from you and for reports of privacy breaches to be received and acted upon in accordance with the Act
(d) Conduct risk assessment for all new and significant business projects which consider privacy impacts
(e) Provide an option for you to use a pseudonym or otherwise be anonymous unless we determine it is impermissible, impractical or inhibits the adequacy or quality of service provided to you
(f) Appoint a Chief Executive Officer to oversee privacy governance processes, ensure compliance with the Act and report on privacy issues to our senior leadership team and the Board
(g) Provide this Policy free of charge and in an appropriate form for public access
(h) Provide relevant work training and privacy awareness on how the Act applies to us and how it is reflected in privacy practices, procedures and systems
(i) Periodically review this Policy as well as the privacy practices, procedures and systems across our organisation to ensure that they remain appropriate to the changing environment we operate in and will notify you by, informing you in our regular communications or posting an updated version of this Policy on our website.


6. Purpose for which we Collect, Use, Store and Disclose Personal Information

We will only use personal information that you provide to use for the purpose disclosed at the time of collection, or otherwise in accordance with this Policy and the Act.
We may collect, use, store and disclose your personal information for several purposes, including:
• To interact with you and to provide you with our services;
• To review and improve our products and services;
• To process donations and issue tax receipts;
• To process your desire to volunteer;
• To communicate with you, including thanking you for your support, responding to any requests, complaints or enquiries, to send you updates and newsletters and to let you know about opportunities (e.g. employment, volunteering, ways to support and events);
• To provide you with marketing and promotional material, including by direct marketing to you from us or from third parties including, without limitation, social networking sites and by our related bodies;
• to enable corporates, commercial associates, suppliers and business partners, agents, consultants and professional advisers who work with us to help provide, promote or improve the products or services we provide (unless you tell us that you opt-out of the use of your personal information for these purposes);
• To assess your application for employment or to volunteer;
• To enter you in to any promotions we might run;
• For any other purposes that we tell you about at the time of collection, or that you authorise; and
• For any purpose that is authorised or required by law.


7. Disclosing your personal information

In some cases, we may disclose your personal information to third parties for the purposes set out above. These third parties may include:
(a) Agencies that we contract to do services on our behalf, for example telemarketing, fundraising suppliers, marketing suppliers or corporates, commercial associates, suppliers and business partners, agents, consultants and professional advisers who work with us to help provide, promote or improve the products or services we provide.
(b) Stripe, which may process donations made to us. Details you provide via Stripe are collected by Stripe in accordance with Stripe’s Terms of Use for provision of their payment services, including risk assessment and authorisation by their bank. Your Information will be subject to Stripe’s Security and Privacy Policy. You can read more about how Stripe manages your data here.
(c) Funraisin and other third party payment platforms which may process donations made to us. Details you provide via Funraisin and other platforms are collected in accordance with their Terms of Use for provision of their payment services, including risk assessment and authorisation by their bank. 8. Opting out of Communications

If you do not wish to receive marketing or promotional communications from us, you should “unsubscribe” online where a link is provided. In other circumstances, you can contact us at hello@orangesky.org and we will cease the relevant marketing or promotional communication at your request.


9. Website Usage Information

Anyone can visit our Website without telling us who you are or revealing any personal information. We will only collect aggregate information about the number and types of visitors. This is anonymous statistical data and we will not attempt to identify users on their web browsing activities. We use this data to evaluate our website performance and improve the content of the website.


10. Storage of Personal Information

We take all reasonable steps to protect all of the personal information we hold from loss, misuse, and from unauthorised access, modification or disclosure. Your personal information will be stored on a password protected electronic database, which may be on our database, a database maintained by a cloud hosting service provider or other third party database storage or server provider. We take reasonable steps to ensure only relevant staff have access to personal information.

The personal information we collect and hold may be transferred to, stored and processed at our offices at 17 Dover Street, Brisbane, QLD Australia.
