1. Our Privacy Commitment

Orange Sky New Zealand cares about protecting your privacy and is required by law to comply with the Privacy Act 1993 (the Act). The Office of the Privacy Commissioner provides further details of the New Zealand Privacy Act and how it protects personal information in New Zealand.
We take our privacy obligations seriously and this Policy outlines our privacy practices. It explains how:
(a) We collect, manage, use, store and secure your personal information
(b) You may access and request correction of any record containing your personal information
(c) You may make a complaint about a breach of privacy


2. Scope

This Policy applies to our staff, volunteers, contractors and suppliers who handle personal information collected by Orange Sky Australia and its related entities from time to time.
By providing your personal information to us, you consent to the use, storage and disclosure of the personal information you provide to us as described in this Policy.


3. How we manage your Personal Information

We will:
(a) Take all reasonable steps to ensure we are open and transparent about the way we manage your personal information
(b) Maintain adequate security of personal information to seek to protect it from misuse, interference and loss from unauthorised access, modification or disclosure
(c) Establish reporting channels to receive privacy inquiries from you and for reports of privacy breaches to be received and acted upon
(d) Conduct risk assessment for all new and significant business projects which consider privacy impacts
(e) Provide an option for you to use a pseudonym or otherwise by anonymous unless it is impermissible, impractical or inhibits the adequacy or quality of service provided to you
(f) Appoint a Chief Executive Officer to oversee privacy governance processes, ensure compliance with the APPs and report on privacy issues to our SLT and the Board
(g) Provide this Policy free of charge and in an appropriate form for public access
(h) Provide relevant work training and privacy awareness on how APPs apply to us and how they are reflected in privacy practices, procedures and systems
(i) Periodically review this Policy as well as the privacy practices, procedures and systems across our organisation to ensure that they remain appropriate to the changing environment we operate in and will notify you by, informing you in our regular communications or posting an updated version of this Policy on our website
(j) unsafe work practices or anything which may put the lives, health or wellbeing of anyone at risk.


4. Personal Information we collect and hold

Kinds of Personal Information
(a) We will only collect information about you that is reasonably necessary for our functions or activities which are listed under point 4.3. This may include:
(b) your name, address, contact and bank and credit card details for clients, volunteers, suppliers and donors
(c) your image, video and sound recordings
(d) information associated with web browsing, email, text messaging, phone calls or other electronic interaction with you including your phone number and user name
(e) for donors, details relating to your donations and information relevant to the purpose of better identifying donor sources
(f) for others, other information relevant to the purpose of providing services such as education qualifications, employment history, interests, feedback preferences, user names and passwords and service feedback and complaint details
(g) sensitive information about you that may include your gender, age, date of birth, health, disability, mental health, racial or ethnic origin, criminal convictions, religious affiliation, tax file numbers, and other particulars required as part of our funding obligations and/or that are relevant for the proper provision of the services that we provide
(h) survey and questionnaire responses


5. Collecting, Using and Disclosing Personal Information

Personal information means information or an opinion about an identified individual, or an individual who is reasonably identifiable. We will only use personal information that you provide through this site for the purposes for which you supplied it or, in exceptional situations, for other reasons permitted under the Privacy Act 1993. The types of personal information we collect may include your name, contact information and credit/debit card information.
We may collect and use your personal information for purposes, including:
• To process donations and issue tax receipts
• To thank you for your support, respond to any enquiries, and send you updates and newsletters
• To communicate with you about opportunities (e.g. employment, volunteering and events)
Orange Sky is committed to taking reasonable steps to protect the personal information that is provided to us. We do not sell, swap or give any data to any external company or organisation. Orange Sky will not disclose personal information to any person except where we are required by law to do so. If we have asked your prior permission (which we would usually do at the time of collection), we may share the information with specified third parties.
Providing personal information will always be optional for you. However, some services may not be available to you if you chose note to provide it.


6. Opting out of Communications

If you do not wish to receive marketing or promotional communications from us, you should “unsubscribe” online where a link is provided. In other circumstances, you should contact us on the email addresses below and we will cease the relevant marketing or promotional communication:

Where we are providing services to you, we need to be able to communicate with you in relation to those services.


7. Website Usage Information

Anyone can visit the Orange Sky website without telling us who you are or revealing anything about yourself. Only aggregate information is provided to Orange Sky about the number and types of visitors and we do not collect personally identifiable information. This is anonymous statistical data and no attempt will be made by Orange Sky to identify users on their web browsing activities. We use this data to evaluate our website performance and improve the content of the website. Orange Sky does not collect sensitive information, such as gender, sexuality or beliefs, about supporters or online visitors.


8. Donating to Orange Sky

When you choose to donate money to us through the Orange Sky website via credit card, Orange Sky use Stripe (https://stripe.com/nz) to process your donation. Details you provide via Stripe are collected by Stripe under their Terms of Use for the provision of their payment services, including risk assessment and authorisation by their bank. Your information is protected by Stripe’s Security & Privacy Policy and Stripe’s terms and conditions may wholly or partly supersede the Orange Sky Privacy Policy. Please see the Stripe website to view their Security & Privacy Policy (https://stripe.com/nz/privacy). Your credit card details will not be shown to Orange Sky.


9. Storage of Personal Information

We take all reasonable steps to protect all of the personal information we hold from misuse, interference and loss, and from unauthorised access, modification or disclosure. Your personal information will be stored on a password protected electronic database, which may be on our database, a database maintained by a cloud hosting service provider or other third party database storage or server provider. Orange Sky ensures only relevant staff have access to personal information.

Unfortunately, no data transmission over the internet can be guaranteed to be 100 per cent secure. As a result, while we strive to protect personal information, Orange Sky cannot ensure or warrant the security of any information that you transmit to us, and you do so at your own risk. Once we receive your transmission, we employ our best efforts to ensure its security on our systems which cannot be accessed by outside agencies or non-Orange Sky staff.


10. Access to and Correction of Personal Information

If you wish to access to, or seek correction of, any personal information that Orange Sky holds about you, please request such access or correction in writing to the following address:
